Eclipse Automation Inc. and its affiliates (“Eclipse Automation”) respect your right to privacy. This Privacy Policy explains Eclipse Automation’s policies and procedures regarding information we collect, use, share and safeguard from visitors on our website and for other external stakeholders.

(Address: 130 Thompson Drive, Cambridge Ontario, Canada; Phone: (519) 620 1906) and your local Eclipse Automation entity (jointly referred to as “Eclipse Automation”) are joint data controllers and responsible for data security and the processing of your Personal Data according to the specific purposes mentioned below. Some of the data process purposes listed below may not apply to you. We will only process your personal data for legitimate purposes.
2.1. Data process for job seeking and filling up an empty job position
When you contact us for apply to an open job position, or when your resume reaches us through an intermediary, you will share personal data with us. This personal data helps us to keep in touch with you, to determine your qualifications, employability and professional experience, and to understand your personal goals and motivations. You will usually share this data with us in a resume and cover letter. Data processed: First name, last name and other identification data; Contact information (e.g., personal phone number, personal email address, home address, mailing address); Data on education, training and language skills; Records of previous work experience and references; Data on wage claim; Personal goals and motivations; Details of previous recognitions, awards, publications; Field of interest, hobby etc. It is common that you share a photo of yourself, or you share a copy of your educational qualifications (e.g. vocational qualification, certificate, diploma, language exam, etc.) with us to support the above information. The above data will be processed with your given consent. If you are not selected to fill a position, your records will be stored in our system until the end of the 2nd year from the date we received your data, so we may contact you within this period if we can offer another job to you.
If you and we mutually agree to fill a position, additional personal data processing is required for employment purposes. We usually request this data from you, after our oral agreement. Data process is required to prepare the employment contract and to report to the authorities. The scope of data to be processed is: Your first name, last name and birth name; ID Card number or copy of the card; Address Card data or copy of the card; Tax Identification Number or copy of the document; Social Security Number or copy of the document; Pensioner registration number or copy of the document – in case of retired employee; Your signature; Documents certifying the education and trainings; Amount of salary and other benefits; Bank account number and name of the bank – for transfer salary. The process of the above data is obligatory, and will be retained until the last day of the 7th year from the date of you quit. Data will be retained for employment, wage and social security records for 5 years after reaching the applicable retirement age.
2.2. Data Process for inquiry, contact and personal visit
If you are an employee, agent, or representative of our buyer/supplier or any of our other external stakeholder (such as an inquirer, requester, representative of an authority/office), we will process certain personal data. We do this to keep contact with you and to communicate effectively with you. We process your first name and last name, job position, company/office where you work, work (business) phone number, work (business) cellphone number, work (business) fax number, work (business) email address.
In the case of a personal visit, in addition to the above data, we may process the date and time of your visit and your location. If you connect your mobile phone or computer to our internal LAN network, we will also process your login name and name, MAC address of your devices. We process this data for our legitimate interest and retain it until the end of the 5th year after the purpose is reached.
2.3. Fulfillment of contractual and business obligations
In some cases, we process your data in order to meet our contractual obligations. In the course of our contractual obligations, we process your first name and last name, job position, company/office where you work, work (business) phone number, work (business) cellphone number, work (business) fax number, work (business) email address, your signature (e.g. for signing a contract, statement, report, meeting minutes, attendance sheet, etc..). We process this data for our legitimate interest and retain it until the end of the 8th year from the termination or performance of the contract or agreement.
2.4. Application of camera surveillance system
We use electronic surveillance system (security camera system) at our facilities. The purpose of this, to protect private property and develop safer working practices. The camera system is designed to detect unauthorized access, burglary, theft and other damage to the facilities, and to help to investigate the causes and circumstances of an accident in the event of a work accident. Processed data: Photo and video recording of you, and related location and date. Use of the system is subject to the local laws and regulations in force at the location of the facility. We process these data based on our legitimate interest. Recordings are kept for up to 72 hours, when unused.
2.5. Cookies and other technologies on Eclipse Automation website
When you visit the Eclipse Automation website https://www.eclipseinnovations.com/, we may use cookies, pixel tags, analytics tools, and other similar technologies to help provide and improve our services as well as optimize the users’ experience.

4. Access to data and data security measures
The personal data you provide will be accessible to our management (President, Vice Presidents/BU Leads, Directors, Department Leaders and Shop Supervisors) and our Data Processing Staff to perform their duties.
We would also like to inform you that we have a statutory duty to report personal data to the tax and other authorities regarding employment.
The security of your data is important to us. The personal data you provide is stored electronically at our Business Units (BU) on our proprietary servers. Data transfer between Business Units takes place over an encrypted virtual private network. Paper-based data is stored in lockable filing systems and locked offices equipped with access control and alarm systems. We take appropriate measures to protect your personal data from unauthorized access or alteration. For example the access to the servers is logged, so we always control who and when has accessed your personal data.

5.1. The right to be informed and the right of access
At your request, we will provide the following information:
- the scope of data we process and the categories of personal data that we process,
- the purpose of data process,
- the legal basis for data process,
- duration of data process,
- the length of time for which the data will be stored or, where this is not possible, the criteria for determining this period,
- if the data were not collected from you, any available information about their source,
- data of the Data Processor, if we have used a data processor,
- the circumstances, effects and measures taken to address the privacy incident; and
- the legal basis, purpose and recipient of the transfer of your personal data.
This information is free of charge if you have not yet requested information from us for the same set of data in the current year. In other cases, we may charge you a fee. Reimbursement of costs already paid shall be refunded if the data have been unlawfully processed or the request for information has led to rectification.
5.2. The right to rectification
You have the right to correct inaccurate personal data about you without undue delay upon your request. You have the right to request that your personal data be completed.
5.3. The right to erasure
You have the right to delete personal data about you without undue delay upon your request, and we are obliged to delete personal data relating to you without undue delay, unless otherwise required by obligatory data process.
5.4. The right to restrict processing
You have the right to restrict the processing of data upon your request.
If the information available to you indicates that deletion would harm your legitimate interests, we will lock the information. The personal data so locked will only be processed for as long as there is a purpose for which the personal data have been deleted.
Data should be locked if
- the data processing is unlawful and you are against the deletion of the data and instead ask for restrictions on their use;
- We no longer need personal data for the purpose of data process, but you require it to make, assert or defend legal claims; obsession
- You have objected to the data process; in this case, the limitation applies to the period until we determine whether our legitimate reasons take precedence over your legitimate ones.
5.5. The right to data portability
You have the right to receive personal data about you made available to us in a structured, widely used, machine-readable format (such as a pdf or excel file), and to forward it to another Data controller if:
- data process is based on consent; and
- Data process is automated.
When exercising your right to portability of data, you have the right to request the direct transfer of personal data between Data controllers, where technically feasible.
5.6. Right to object
You may object to the process of your personal data, including profiling, if
- the processing (transfer) of personal data is only necessary for the enforcement of our rights or our legitimate interests, except in the case of obligatory data processing;
- the use or transfer of personal data for direct marketing, opinion polling or scientific research;
- the exercise of the right of protest is otherwise permitted by law.
You may object to the processing of your personal data for the purpose of direct marketing, and your personal data may no longer be processed for this purpose.
6. Laws and regulations underpinning data process, law enforcement
Processing of personal data is governed by the General Data Protection Regulation of the European Union (GDPR). We also apply the laws and regulations of processing of personal data applicable in the location of our respective Eclipse Automation entity.

Any information concerning individuals about whom Eclipse Automation holds information may be subject to the requirements of the PERSONAL INFORMATION PROTECTION AND ELECTRONIC DOCUMENTS ACT, 2000, c. 5 and other laws governing privacy.
United States
U.S. citizens are covered under the Fourth Amendment (right to be free of unwarranted search or seizure), the First Amendment (right to free assembly), and the Fourteenth Amendment (due process right). All federal and state laws regarding sharing personal information and right to privacy will be obeyed.
Europe
